Terms & conditions
Version: 1.0 for review
Date of preparation and research: 11 October 2026.
Purpose: Site text after review and approval
1. Subject and operator
These terms govern access to the public content of mensch.rs and use of its general functions. The operator is Mensch doo, identified in Business data.
Special rules for paid services, user accounts, MenschOS, and contracted projects apply when presented to the user and validly agreed. This page does not change an existing contract by being published alone. Provisions requiring consent become part of the relationship only in accordance with the rules on concluding contracts.
2. Information on the site and inquiries
The site serves to present services, publish information, and establish contact. A service description, showcase of work, or call to request an offer is as a rule not a final offer with all essential terms. If a specific publication explicitly represents a binding offer, its effect is assessed according to content and law. Sending an inquiry does not create an obligation to purchase or general consent to marketing. For engagement, the contracting party, subject matter, price or method of calculation, deadlines, payment terms, and other essential elements must be clear. Confirmation of receipt of a message differs from acceptance of the work. A user acting on behalf of an organisation should have appropriate authority. Providing a business email address alone does not establish personal guarantee or unlimited liability of the sender for the organisation's debts.
3. Permitted use
You may use the site for information, business communication, and other functions made available to you. Linking to public pages is permitted, provided the manner of presentation does not create a false impression of partnership, endorsement, or authorship. Unauthorised access to accounts or data, bypassing access restrictions, spreading malicious content, disrupting system operation, misleading representation, or sending content that infringes others' rights is not permitted. Automated use that loads the system or bypasses protection is not permitted. These rules do not abolish statutory exceptions and limitations of copyright or other rights that cannot be excluded by contract. Vulnerability testing requires appropriate authorisation; the possibility to report a bug is not general permission for testing.
4. Materials you submit
Submit only material you are authorised to share and that is needed for the inquiry or agreed work. Sending material for project assessment does not automatically transfer copyright to MENSCH and does not grant permission for its public publication or use for training AI models. The scope of necessary use of material to prepare an offer or provide a service is governed by the purpose of submission and the contract. If a confidentiality agreement or special submission channel is needed, terms are agreed before sending especially sensitive material.
5. Intellectual property
Rights to texts, design, photographs, video, software, and other content belong to the respective rights holders. Detailed rules are on Copyright and intellectual property. Access to the site does not grant the right to commercial reproduction, adaptation, or distribution outside what is permitted by contract, licence, or law.
6. Availability, changes, and restriction of access
The public site may be temporarily unavailable due to maintenance, technical problems, or other circumstances. These terms do not contract a specific level of availability for the public site. If a level of service is agreed for a paid service, the relevant contract and SLA apply. Access may be proportionately restricted to prevent specific misuse or to comply with a legal obligation. Restriction must not serve to unjustifiably deny user rights, access to legal information, or the ability to submit requests.
7. Liability
Each party is liable according to applicable law and its contractual obligations. These terms do not exclude liability that cannot be excluded, including liability for intent or gross negligence under applicable rules of Serbian law, nor do they limit mandatory consumer rights and rights relating to personal data. Site content provides general information about services. Assessing its applicability to an individual project requires agreement on specific requirements. That does not release the provider from liability for misleading statements, explicit promises that produce legal effect, or contracted characteristics of the service.
8. External links
A link to another site may serve information or display a reference. It does not by itself endorse the entire content of that site. The operator's obligations regarding its own choice, presentation of the link, or transfer of data are assessed independently of the external provider's liability.
9. Governing law and disputes
For use of the site operated by the Serbian company, the law of the Republic of Serbia applies as a starting point, with mandatory conflict-of-law rules and mandatory regulations that apply. These terms do not designate unverified exclusive court jurisdiction, mandatory arbitration, or waiver of legal remedies. For a specific contract with another legal entity, governing law and jurisdiction are governed by that contract within permitted limits. A consumer does not lose protection of mandatory regulations applicable to them because another law is stated in the contract.
10. Changes and contact
The current version and effective date are highlighted on this page. Changes do not retroactively alter already concluded contracts. For material changes to agreed terms, the appropriate procedure of notice and acceptance is carried out when required. Questions and reports are sent to hi@mensch.rs. For personal data and complaints, use the guidance on Contact and exercising rights.
